On 27 August 2021, amended regulations relating to the Promotion of Access to Information Act, No. 2 of 2000 (“PAIA”) were issued.  The amended Regulations impose additional obligations on Information Officers.

In terms of PAIA, the Information Regulator must update and make available the section 10 guide, originally compiled by the South African Human Rights Commission, which sets out how a person can exercise their rights in terms of PAIA.

The Regulations stipulate that an Information Officer must have a copy of the guide available for public inspection, in at least two of the official languages, at the registered head office.  An Information Officer may not charge a fee for a copy of the guide or for the inspection of a copy of the guide.

An Information Officer is obliged to assist a requester when making any request in terms of PAIA.  If the requester is illiterate or disabled, the Information Officer is obliged to complete the request form on behalf of the requester.
